1. Acceptance of These Terms

These Terms and Conditions ("Terms") govern all pre-orders and purchases made through eatferra.com (the "Site"), operated by Farah Kitchen Inc., a Delaware corporation ("Ferra," "we," "us," or "our").

By placing an order, creating an account, or otherwise using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site or place an order.

These Terms apply to all products sold on the Site, including pre-order items such as Period Brownies and any future products we release. We may update these Terms at any time; see Section 10 below.

2. Pre-Orders

Products marked "pre-order" are not yet in stock or fully in production. Placing a pre-order reserves your item ahead of manufacturing and shipment.

• Estimated ship dates are estimates, not guarantees. We're targeting shipment by the end of November 2026. That date is an estimate and may change due to manufacturing timelines, ingredient sourcing, co-manufacturer capacity, or other factors outside our control. We will notify you by email of material delays.
• Payment. Payment is captured in full at the time you place your pre-order, before the product ships.
• Changes and cancellations. You may cancel a pre-order for a full refund any time before it ships by emailing hello@eatferra.com. Once an order has shipped, our standard return policy (Section 5) applies instead.
• Our right to cancel. We reserve the right to limit quantities, cancel orders we reasonably suspect are fraudulent, or cancel and refund a pre-order in full if we're unable to fulfill it (for example, if a product is discontinued before launch).

3. Product, Health, and Safety Information

Not medical advice. Ferra products are foods, not drugs. Statements about our products have not been evaluated by the FDA. Our products are not intended to diagnose, treat, cure, or prevent any disease. Nothing on the Site is medical advice, and it should not replace the advice of a physician or other qualified healthcare provider.

Talk to your doctor first if: you are pregnant or nursing, are taking medication, have a medical condition, or in particular have hemochromatosis, hemosiderosis, or any other iron overload or iron absorption disorder. Period Brownies contain added iron (Ferrochel® ferrous bisglycinate chelate) and magnesium citrate, and added iron is not appropriate for everyone.

Keep out of reach of children. Accidental overdose of iron-containing products is a leading cause of fatal poisoning in children under 6. Store this product where children cannot access it. In case of accidental overdose or ingestion by a child, call a doctor or Poison Control (1-800-222-1222 in the US) immediately.

Use as directed. Do not exceed the serving size stated on the package. Ferra is not responsible for adverse effects that result from consuming more than the recommended serving, from using the product contrary to package directions, or from use by someone for whom the product isn't appropriate.

Allergens. This product is not made in a dedicated gluten-free facility or a dedicated nut-free facility. We follow a cross-contamination control process for our gluten-free product, but can't guarantee a completely allergen-free environment. Always check the package for the current ingredient and allergen list, which controls over anything on this Site.

Vegetarian-friendly. This product is not currently Halal-certified. See the package for current certification details.

4. Shipping and Delivery

We currently ship within the United States only. International shipping (including the UK and Canada) is on our roadmap but not yet available; if you're outside the US, sign up to be notified rather than placing an order.

Current pre-orders are expected to ship by the end of November 2026; ship dates given at checkout or by email are estimates and may shift. Risk of loss and title pass to you once we hand your order to the shipping carrier. We're not responsible for delays caused by the carrier or other events outside our control.

5. Returns, Refunds, and Cancellations

Because our products are food, orders can't be returned once they've shipped.

• Unshipped pre-orders: cancel any time before shipment for a full refund (Section 2).
• Damaged or incorrect orders: email hello@eatferra.com within 7 days of delivery with photos, and we'll send a replacement or refund.
• Everything else: if you're not satisfied, contact hello@eatferra.com and we'll work with you case by case; we don't guarantee a refund outside the situations above.

6. Assumption of Risk and Limitation of Liability

By purchasing and consuming Ferra products, you confirm that you have read the product and ingredient information and the usage instructions on the package, and that you assume all risk associated with consuming the product.

To the fullest extent permitted by law, FERRA Kitchen Inc. and its officers, employees, and affiliates are not liable for any injury, illness, allergic reaction, or other adverse effect arising from:

1. consuming the product in excess of the recommended serving size;
2. failing to follow the label instructions or warnings;
3. a pre-existing medical condition, allergy, sensitivity, or intolerance not disclosed to us or not appropriate for this product;
4. improper storage or handling after delivery; or
5. use by someone the product isn't intended for, including children without adult supervision.

No warranties. Products are provided "as is." To the extent permitted by law, we disclaim all warranties other than those that can't be excluded under applicable consumer protection law.

Liability cap. To the maximum extent permitted by law, our total liability for any claim relating to your purchase is limited to the amount you paid for the product giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

Nothing in this section limits liability that cannot legally be limited or excluded, such as liability for gross negligence, willful misconduct, or death or personal injury caused by a defective product, where applicable law does not permit that liability to be waived.

7. Indemnification

You agree to defend, indemnify, and hold harmless Farah Kitchen Inc. and its officers, employees, and affiliates from any claim, loss, or expense (including reasonable attorneys' fees) arising from your misuse of the product, your violation of these Terms, or your violation of any law or third-party right.

8. Intellectual Property

All content on the Site — including the Ferra name and logo, product names, photography, recipes, and copy — is owned by Farah Kitchen Inc. or its licensors and may not be copied, reproduced, or used without our written permission.

9. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Any dispute arising from these Terms or your purchase will be resolved in the state or federal courts located in Delaware, and you consent to that jurisdiction and venue.

10. Changes to These Terms

We may update these Terms at any time by posting the revised version on the Site with a new effective date. Changes apply to orders placed after the update. If a court finds any part of these Terms unenforceable, the rest remain in effect. These Terms are the entire agreement between you and Ferra regarding your purchase, superseding any prior versions.
